EB-5 IMMIGRATION REFORM LAW & COSTS

On March 15, 2022, the EB-5 Immigrant Investor Program was officially renewed by the US Congress after being suspended on June 30, 2021.

Under the reform law, new applications must submit a minimum EB-5 investment of $800,000 in a TEA (Targeted Employment Area – Area with high unemployment rate of 150% or more compared to the national average) and $1,050,000 in a Non-TEA (Non-Targeted Employment Area). The minimum investment amount in these two areas will remain stable until 2027.

Who is the UK Spouse Visa for?

The UK Spouse Visa allows you to live, work, and build a life in the UK with your partner if:

Your partner is 

  • A British or Irish citizen

  • Someone who is settled in the UK (holds Indefinite Leave to Remain or Settled Status)

  • A person with Pre-Settled Status under the EU Settlement Scheme

  • Someone with a Turkish Businessperson or Turkish Worker visa

  • A person granted refugee status or humanitarian protection in the UK

  • You are married or in a civil partnership.
  • You and your partner are not within a prohibited degree of relationship;
  • You and your partner have met in person;
  • You and your partner are legally married in a marriage that is recognised in the UK;
  • Your relationship is genuine and subsisting;
  • You are engaged and plan to marry in the UK within 6 months (this is known as the Fiancé(e) Visa, which can later be switched to a Spouse Visa after marriage).

  • Financial Requirement
    Your UK-based partner must earn a minimum of £29,000 per year (as of April 2024), or have savings to meet the threshold. This may vary depending on your situation (children, employment type, etc.). 
  • If your partner doesn’t meet the £29,000 annual income requirement, you must have at least £88,500 in cash savings.

LIVING TOGETHER

    You must have suitable accommodation in the UK where you can live together without relying on public funds.

Who is Financé Visa for?

If you’re engaged and want to get married in the UK, the Fiancé(e) Visa allows you to enter the UK for 6 months for the purpose of marriage. After the wedding, you can apply for a Spouse Visa from within the UK, without leaving the country.

This is perfect for couples who want to start their life together on UK soil.

How Long Does the Visa Last?

The initial Spouse Visa is granted for 2 years and 9 months (or 2 years and 6 months if switching from inside the UK).

It can then be extended and eventually lead to Indefinite Leave to Remain and even British citizenship.

1. What is an EB-5 Visa?

The EB-5 Visa is a program that grants US green cards to foreign investors when they invest in projects in the US, creating at least 10 full-time jobs for US workers.

To participate in the EB-5 program, investors must meet the following conditions:

  1. Investment: Minimum $800,000 in priority areas or $1,050,000 in other areas.
  2. Job Creation: Project must create at least 10 full-time jobs for US workers.
  3. Legal source of funds: Investors must prove legal source of funds to make the investment.

Investment commitment: the investor must participate in a new commercial enterprise.

  • Select an investment project: The investor selects an eligible EB-5 project and invests the required amount of capital.
  • File Form I-526E: This is the EB-5 immigrant petition, demonstrating the source of funds and the project’s legitimacy.
  • Receive I-526E approval: Typically 14–18 months after submitting the petition.
  • File Form I-485 or DS-260: If the investor is lawfully in the U.S., they can file Form I-485 to adjust status and apply for a Green Card. If outside the U.S., they must file DS-260 to apply for an EB-5 visa.
  • Consular interview: The investor attends an interview at the local U.S. consulate or with USCIS.
  • Receive conditional Green Card: After a successful interview, the investor receives a conditional Green Card valid for 2 years.
  • File Form I-829: After 2 years, the investor files Form I-829 to remove conditions and obtain a permanent Green Card.

  • Requirements from USCIS (U.S. Citizenship and Immigration Services): USCIS requires investors to clearly demonstrate the source of EB-5 funds and that the transfer process is legal.
