ELITEVISA provides business and administrative support services to assist with the preparation of visa-related documents, in accordance with instructions from qualified solicitors appointed by our clients. We also connect clients with experienced immigration solicitors for legal guidance and case handling. Additionally, we offer access to automated tools to help assess business readiness and visa application preparedness (collectively, the “Services”).

By using theelitevisa.com, you acknowledge and agree to be bound by these Terms of Service, which also incorporate our Privacy Policy. If you do not agree to these terms, please do not use our Site or Services.

 

The ELITEVISA Site and Services

  1. Legal Connections
    ELITEVISA provides services that enable you to connect with independent, qualified immigration solicitors and lawyers across multiple jurisdictions, including the UK, United States, European Union, Canada, Australia, and other countries. These professionals may provide legal guidance on matters such as visa applications, sponsor licences, and general immigration processes. ELITEVISA itself does not offer legal advice or representation, but instead facilitates introductions between clients and third-party legal professionals for direct consultation and case management. 
  2. Support Tools and Services
    We offer access to automated and AI-powered tools, including application readiness assessments and document preparation assistance. These tools are designed to help you evaluate the overall quality and completeness of your visa or sponsor licence application. They may be used on their own or in conjunction with legal consultations. However, they are not intended to replace advice from a qualified immigration lawyer or solicitor. 
  3. Definition of “Assessment”
    In this Agreement, “Assessment” refers to:
    i) the document and business readiness evaluations conducted using ELITEVISA’s software and tools, and/or
    ii) AI-generated reports and recommendations aimed at assisting you in preparing for a visa or sponsor licence application.
    These Assessments are for informational and preparatory use only and should not be construed as legal advice or an application decision predictor. 
  4. No Legal Relationship
    You acknowledge that ELITEVISA is not a law firm, does not provide legal services, and that no solicitor-client or attorney-client relationship is established between you and ELITEVISA at any point. All legal services are provided exclusively by third-party legal professionals who operate independently and are directly engaged by you. 
  5. Informational Purposes Only
    Any support, information, insights, or recommendations you receive from ELITEVISA—whether through staff, automation tools, or documentation support—are offered solely for general informational purposes. They are not a substitute for personalized legal advice, and do not constitute a guarantee of success in any visa or immigration application process. 
  6. Limitations on Legal Guidance
    ELITEVISA does not and cannot provide legal or procedural advice related to immigration laws, application form selection, document requirements, submission deadlines, visa categories, or compliance specifics in any jurisdiction (“Legal and Procedural Matters”). All such inquiries must be addressed to a qualified immigration solicitor or lawyer. 
  7. User Responsibility
    By using our Services, you agree not to rely on ELITEVISA, its staff, or its digital tools for Legal and Procedural Matters. You accept that it is your responsibility to seek guidance from a qualified legal professional regarding any country-specific immigration questions or issues that may impact your application.

Non-Legal Services

ELITEVISA is not a law firm and does not provide legal advice. None of our services establish a solicitor-client or attorney-client relationship. Our role is to support clients with administrative tasks, such as organizing documents and guiding you through the preparation process for visa and immigration-related matters.

Our team—including Immigration Support Coordinators, Visa Process Assistants, and Client Support Officers—is trained to assist with non-legal, procedural, and logistical support. They are not licensed solicitors, lawyers, or government officials and are not authorized to interpret immigration law or provide legal opinions.

Independent Legal Support

Where legal services are required, ELITEVISA may refer you to independent, qualified immigration solicitors or lawyers licensed in jurisdictions such as the UK, US, EU, Canada, Australia, and others. Any legal advice or representation is provided directly by the solicitor under a separate engagement, independent of ELITEVISA.

Information Handling and Submission

ELITEVISA does not offer online client accounts or portals. Instead, all communication and document exchange occurs through email, messaging apps, or other direct communication channels. Each client’s materials are securely stored and managed offline in internal folders, strictly for case preparation and coordination purposes.

Please use only our official contact methods—such as email or approved messaging—for submitting sensitive or case-related information. Do not send confidential information through unofficial channels or third-party services not endorsed by ELITEVISA.

Informational Purpose Only

The content, materials, and administrative support provided by ELITEVISA are intended for general informational purposes and preparation only. Immigration laws vary by jurisdiction and are subject to frequent change. While we aim to provide clear and relevant guidance, you should always verify legal matters with a qualified immigration solicitor.

No Government Affiliation

ELITEVISA is a private, independent company and is not affiliated with, endorsed by, or connected to any immigration authorities or government agencies in the UK, US, Canada, Australia, EU, or any other jurisdiction.

Submissions and Liability

All submissions you provide—whether via email, forms, or messaging—are your responsibility. ELITEVISA is not liable for the outcome of your case or for any delays, errors, or omissions arising from inaccurate or incomplete submissions.

Payment Policy

Payments for ELITEVISA’s services must be made through official ELITEVISA channels. Under no circumstances should payments or payment information be given directly to support staff or through unapproved means.

 

General Disclaimer and Limitation of Liability

At ELITEVISA, we are committed to maintaining our website and services to be secure, reliable, and as accurate as possible. However, you access and use the Site and Services entirely at your own risk.

All information and services offered through the Site are provided “as is” and “as available,” without warranties of any kind, whether express or implied. ELITEVISA expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and any guarantees of outcome for visa or immigration-related processes.

We cannot guarantee the Site and Services will be error-free or uninterrupted. ELITEVISA, its directors, employees, affiliates, or representatives shall not be held liable for any direct, indirect, incidental, special, or consequential damages, including loss of income, business interruption, data loss, legal disputes, or any other harm resulting from your use—or inability to use—the Site and Services, even if we were advised of the possibility of such damages.

No information obtained from ELITEVISA, whether oral or written, shall create any warranty not explicitly stated in this agreement.

To the extent permitted under applicable Vietnamese law, ELITEVISA’s liability to you for any claim, regardless of the legal theory or cause of action, will be strictly limited to the greater of: (a) the total amount you paid to ELITEVISA in connection with the Site and Services during the twelve (12) months before the claim arose; or (b) fifty U.S. dollars (USD $50).

If no fees have been paid to ELITEVISA, you agree that your sole remedy shall be injunctive or equitable relief, and you will not be entitled to any monetary damages of any kind.

This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.

You Agree to Indemnify ELITEVISA

You agree to indemnify, defend, and hold harmless ELITEVISA, its contractors, licensors, subsidiaries, affiliates, and their respective partners, directors, officers, employees, and agents from and against any and all claims, losses, liabilities, costs, and expenses (including attorneys’ fees) arising out of or related to:

  1. Your use of the ELITEVISA website and services;
  2. Any User Content, Third Party Content, Third Party Sites, or any other content;
  3. Your violation of this Agreement, any applicable law, or the rights of any third party; and
  4. Your breach of any representation or warranty made under this Agreement.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to any conflict of law principles. Any dispute arising from or relating to the use of the Site or the Services shall be first attempted to be resolved amicably. If such resolution is not possible, the dispute shall be submitted to the competent courts of Vietnam for final settlement.

Your General Representation and Warranty

You represent and warrant that you will use the ELITEVISA website and services in full compliance with:

You further represent and warrant that your use of the Site and Services will not infringe upon or misappropriate the intellectual property rights of any third party.

Other Terms

You and ELITEVISA agree that any claim or cause of action arising out of or related to the use of the Site or the Services must be initiated within one (1) year after the claim or cause of action arose; otherwise, it will be permanently barred.

Except for claims related to injunctive or equitable relief or concerning intellectual property rights (which may be brought before any competent court without the need to post a bond), any dispute arising under this Agreement shall be resolved through final and binding arbitration. The arbitration will be conducted in accordance with the rules of a reputable arbitration organization mutually agreed upon by both parties.

You agree that arbitration shall take place in Ho Chi Minh City, Vietnam, in the English language, and any arbitral decision may be enforced in any court with proper jurisdiction. The prevailing party in any legal action or proceeding brought to enforce this Agreement shall be entitled to recover their reasonable legal costs and attorneys’ fees.

If any provision of this Agreement is held to be invalid or unenforceable, it will be interpreted to reflect the original intentions of the parties, and all remaining provisions shall continue in full force and effect.

A waiver by either party of any term or condition of this Agreement or any breach thereof, on any one occasion, will not constitute a waiver of that term or condition or of any future breaches.

ELITEVISA may assign its rights or obligations under this Agreement without restriction.

This Agreement will be binding upon, and will inure to the benefit of, the parties and their respective successors and permitted assigns. The section titles in this Agreement are for convenience only and have no legal or contractual effect.

Class Action and Jury Trial Waiver

For all users of the Site and Services—regardless of whether you have used the Services for personal, commercial, or any other purpose—you agree that any and all claims must be brought on an individual basis only, and not as a plaintiff or class member in any purported class action, collective action, private attorney general action, or other representative proceeding.

This waiver applies to class arbitration as well. Unless ELITEVISA expressly agrees otherwise, the arbitrator shall not consolidate claims from more than one individual or entity into a single proceeding.

By agreeing to these terms, you and ELITEVISA both waive any right to a jury trial, as well as the right to participate in any class action, collective action, or other representative proceeding of any kind.
