What is the UK Self-Sponsorship Route?

The Self-Sponsorship route in the UK is a legal pathway that allows individuals to create and manage their own company, while simultaneously applying for a Skilled Worker visa. This route is designed for entrepreneurs, business owners, and professionals who wish to live and work in the UK but do not want to depend on a third-party employer to sponsor their visa. By setting up your own business and applying for a Sponsor Licence, you can self-issue a Certificate of Sponsorship (CoS), which is the first step in the process of obtaining a Skilled Worker visa.

Although the UK does not currently offer a specific self-sponsorship visa, it is possible to start or invest in a UK-based business and, once that business is granted a sponsor licence by the UK Home Office, use it to sponsor yourself for a Skilled Worker visa.

Similarly, if you already own or co-own a UK business that holds a valid sponsor licence and you meet the criteria for a Skilled Worker visa, this route could serve as an effective way to pursue self-sponsorship.

Requirements

Establish or Acquire a UK Company

You need to either start a new business in the UK or take over/control an existing UK-registered company. The company must be a legitimate trading business.

Obtain a Sponsor Licence

Your company must apply for and be granted a Skilled Worker Sponsor Licence by the UK Home Office. This allows the company to legally sponsor skilled migrant workers — including yourself.

Genuine Job Role Within the Company

There must be a real and skilled role (e.g. Director, CEO, Operations Manager) that meets the criteria for sponsorship under the Skilled Worker visa. The role must be on the list of eligible occupations and meet salary thresholds.

Suitably Qualified for the Role

You need to have relevant skills, experience, or academic/professional qualifications for the role. This is to demonstrate the genuineness of the employment.

English Language Requirement

You must prove your English proficiency at CEFR level B1 (equivalent to IELTS 4.0 in each category). This can be proven through an approved English test, a UK degree, or a degree taught in English and confirmed by Ecctis.

Sufficient Funds

You must show you have sufficient personal funds to support yourself in the UK (usually at least £1,270 held for 28 days). Your company may also need to show financial readiness to pay your salary and run the business.

FAQ - FREQUENTLY ASKED QUESTIONS ABOUT THE EB-5 IMMIGRATION PROGRAM

1. What is an EB-5 Visa?

The EB-5 Visa is a program that grants US green cards to foreign investors when they invest in projects in the US, creating at least 10 full-time jobs for US workers.

To participate in the EB-5 program, investors must meet the following conditions:

  1. Investment: Minimum $800,000 in priority areas or $1,050,000 in other areas.
  2. Job Creation: Project must create at least 10 full-time jobs for US workers.
  3. Legal source of funds: Investors must prove legal source of funds to make the investment.

Investment commitment: the investor must participate in a new commercial enterprise.

  • Select an investment project: The investor selects an eligible EB-5 project and invests the required amount of capital.
  • File Form I-526E: This is the EB-5 immigrant petition, demonstrating the source of funds and the project’s legitimacy.
  • Receive I-526E approval: Typically 14–18 months after submitting the petition.
  • File Form I-485 or DS-260: If the investor is lawfully in the U.S., they can file Form I-485 to adjust status and apply for a Green Card. If outside the U.S., they must file DS-260 to apply for an EB-5 visa.
  • Consular interview: The investor attends an interview at the local U.S. consulate or with USCIS.
  • Receive conditional Green Card: After a successful interview, the investor receives a conditional Green Card valid for 2 years.
  • File Form I-829: After 2 years, the investor files Form I-829 to remove conditions and obtain a permanent Green Card.

  • Compliance with Vietnamese and U.S. Laws: Transferring funds abroad for the purpose of legal EB-5 investment must comply with Vietnam’s foreign exchange regulations as well as U.S. financial regulations.

Priority EB-5 investment areas, known as Targeted Employment Areas (TEAs), include:
