What is the Sponsor Licence?

A sponsor licence is official permission from the UK Home Office that allows a UK business to hire workers from outside the UK.

Since Brexit, many UK employers are facing skill and worker shortages, so sponsor licences have become essential for companies of all sizes across different industries.

The sponsor licence is part of the UK’s immigration system. It helps control and support the hiring of skilled workers from overseas.

Only organisations (not individuals) can apply for a sponsor licence. To get one, a business must apply to the Home Office and show that it meets certain rules and responsibilities related to immigration.

Once approved, the business can give out Certificates of Sponsorship to foreign workers. These certificates let the workers apply for a UK work visa, such as the Skilled Worker visa.

In the past, sponsor licences were valid for four years and needed to be renewed. But since April 2024, there’s no longer a need to renew them—once you have a sponsor licence, it stays valid without renewal.

FAQ - FREQUENTLY ASKED QUESTIONS ABOUT THE EB-5 IMMIGRATION PROGRAM

1. What is an EB-5 Visa?

The EB-5 Visa is a program that grants US green cards to foreign investors when they invest in projects in the US, creating at least 10 full-time jobs for US workers.

To participate in the EB-5 program, investors must meet the following conditions:

  1. Investment: Minimum $800,000 in priority areas or $1,050,000 in other areas.
  2. Job Creation: Project must create at least 10 full-time jobs for US workers.
  3. Legal source of funds: Investors must prove legal source of funds to make the investment.

Investment commitment: the investor must participate in a new commercial enterprise.

  • Select an investment project: The investor selects an eligible EB-5 project and invests the required amount of capital.
  • File Form I-526E: This is the EB-5 immigrant petition, demonstrating the source of funds and the project’s legitimacy.
  • Receive I-526E approval: Typically 14–18 months after submitting the petition.
  • File Form I-485 or DS-260: If the investor is lawfully in the U.S., they can file Form I-485 to adjust status and apply for a Green Card. If outside the U.S., they must file DS-260 to apply for an EB-5 visa.
  • Consular interview: The investor attends an interview at the local U.S. consulate or with USCIS.
  • Receive conditional Green Card: After a successful interview, the investor receives a conditional Green Card valid for 2 years.
  • File Form I-829: After 2 years, the investor files Form I-829 to remove conditions and obtain a permanent Green Card.

  • DS-260 (Consular Processing):
    • For investors outside the U.S.
    • Processing time: 6–12 months, depending on the consulate.

The total cost for an EB-5 US immigration application can range around $900,000, depending on the number of family members, project location and other factors.

  • Requirements from USCIS (U.S. Citizenship and Immigration Services): USCIS requires investors to clearly demonstrate the source of EB-5 funds and that the transfer process is legal.
  • Compliance with Vietnamese and U.S. Laws: Transferring funds abroad for the purpose of legal EB-5 investment must comply with Vietnam’s foreign exchange regulations as well as U.S. financial regulations.
Protecting Investor Interests: A secure transfer process helps ensure investment petition approval and minimizes financial risks.
Priority EB-5 investment areas, known as Targeted Employment Areas (TEAs), include:
  1. Rural areas: Areas located outside metropolitan regions with a population under 20,000.
  2. High-unemployment areas: Areas where the unemployment rate is at least 150% of the national average.
Investing in these priority areas requires a lower investment amount of $800,000 compared to $1,050,000 in other areas.
